What is a performance contract?

A performance contract is an agreement by which the author grants the user the right to publicly recite, perform, or stage the author’s work. In return, the user agrees to pay the author a fee and to carry out the recitation, performance, or staging of the work.

The user is also obliged to allow the author to attend the performance, to ensure appropriate technical conditions for the performance, and to provide the author with the programme, other printed materials, and any public reviews of the performance, unless otherwise specified in the contract.

What can an author do if the publisher does not publish the work within the agreed timeframe?

If the publisher fails to publish the work within the agreed timeframe, the author may withdraw from the contract. In addition, the author may claim compensation and either keep the fee already received or demand payment of the fee agreed in the contract.
