When must scientific publication be published in open access?

A scientific publication must be made openly accessible when the underlying research is financed with at least 50% public funding.
It is also important to note that open access may be provided through either the Version of Record (VoR) or an Author Accepted Manuscript (AAM), as both versions satisfy the open access requirement.
