Exception for public exhibitions and sales of works of art (Article 54 of the Copyright and Related Rights Act)

The organizer of a public exhibition or sale of works of art may use such works in connection with the event, to the extent necessary for its promotion, provided that no economic benefit is derived from this use. When relying on this exception, the source and author must be indicated, if known.


Example: A library organizes an exhibition of works by local artists. In order to attract visitors, it publishes photographs of the exhibited artworks on its website and promotional posters. Since this use serves solely to promote the event and is not intended for commercial gain, the library may do so without obtaining special authorization, provided that it credits the artists and indicates the source of the works.
