Can a professor include a copyrighted photograph in a textbook?

Yes. A professor may include a copyrighted photograph in a textbook intended for teaching purposes, provided that the photograph has already been lawfully published and that the author and source are properly acknowledged.

Although the use of such works does not require the transfer of economic rights, remuneration must be paid for their use. This compensation is typically paid by the publisher of the textbook and is managed through a collective management organization (for example, ZAMP in Slovenia). Publishers of educational textbooks are required to notify the collective management organization of each new edition of a textbook that includes copyrighted works in the fields of literature, science, and journalism, as well as their translations, before publication.
