Do researchers have to deposit an article in an institutional repository?

Article 41 of the Scientific Research and Innovation Activities Act requires open access to research results when the underlying research is funded at least 50% from public sources. This means that the researcher or the research-performing organization must ensure free access to the results, which may include depositing the article in an open access institutional repository.

A researcher is therefore obliged to deposit an article in an open access institutional repository only when the research was publicly funded at least 50%.

If a researcher does not ensure open access, no statutory sanctions are prescribed. Thus, there are no direct legal consequences under the Act itself.

However, individual research institutions may have their own internal policies that require open access and may impose sanctions for non-compliance. Researchers should therefore always consult the relevant internal rules of their institution.
